Terms and conditions

Given below is an outline of the principal clauses of the management agreement used by the Company. Any landlord entering into
an agreement with the Company will, of course, receive a full written agreement, and may take legal advice before completing it.

Agent's Obligations

  • Seek tenants for the Property from nominees supplied by a local authority or from any list held by the Company
  • Prepare a Tenancy Agreement for signature by the Tenant.
  • Order necessary repairs with an estimated value of up to £100 (net of VAT) and/or emergency works from time to time without first notifying the Landlord
  • Order necessary repairs with an estimated value of £100 or over (net of VAT) with the Landlord's consent
  • Receive Rent payments from the Tenant including housing benefit paid direct by local authorities
  • Serve any necessary notices upon the Tenant
  • Ensure that any necessary documents necessary for taxation purposes are retained.

Landlord's obligations

  • Insure the Property against fire, flood, heave, landslip and other structural problems
  • Not do anything relating to the Tenancy Agreement except through the Company
  • Ratify all things properly done by the Company
  • Not place the Property for sale except within the last 28 days of the Term
  • Pay any Council Tax or standing charges for gas, electricity, water or sewage treatment during periods when the property is empty
  • Meet the cost of all repairs organised by the Company
  • Pay any costs relating to action taken in the County Court arising from the Tenancy Agreement

Fees

  • 10% of the Rent collected in the previous month together with 10% of the cost of repairs organised by the Company for the Property and paid in the previous month.
  • The Company may deduct from the rent payments due to the Landlord any sums payable by the Landlord to the Company, any VAT or other sums due to any taxation authority in relation to the Property, the Agent's fee, or this Agreement, any sums claimed by local authorities as being housing benefit overpaid by those authorities to the Company on the Landlord's behalf and which the local authorities now wish to recover and the cost of any repairs ordered by the Company for the Property
  • Where either party gives notice to terminate the Agreement, the Company will withhold all payments due to the Landlord until one calendar month after the date of termination at which time a closing statement will be prepared and sent, together with any rents owing (less any allowable deductions) to the Landlord
