This form is for the use of tenants of SHAL Housing. People who wish to exchange houses with tenants of SHAL Housing may also use it.

Please do not move or make any arrangements to move until you have submitted the following application form and received WRITTEN APPROVAL from SHAL Housing Limited (and other Landlord if applicable) for the exchange to go ahead. You may lose your Assured Tenancy if you do.

We/I consent to this information being held in paper form and recorded on a computer system in connection with our mutual exchange application and with any tenancy we may hold in the future. We/I understand that, and agree that, this information may be used for statistical purposes and that contractors working with SHAL Housing Limited may have access to the data in connection with their work for SHAL. This data may be held for a period of six years from the date of this application, or six years from the termination of any tenancy, whichever is the later.

IMPORTANT INFORMATION

Your right to exchange your Tenancy by assignment with that of another tenant (of a Housing Association or a Local Authority or New Town) is subject to the prior written consent of SHAL, which may be subject to conditions and which shall only be withheld on the following grounds:-

1. Where a Court Order has been made giving possession of the Tenant's dwelling to the landlord;
2. Where a notice of seeking possession has been served on either the Tenant or the person to whom the Tenant proposes assigning his tenancy;
3. Where the Tenant's dwelling is substantially larger than is reasonably needed by the person to whom the Tenant proposes assigning his tenancy;
4. Where the Tenant's dwelling would be too small for the needs of the person to whom the Tenant proposes assigning his tenancy;
5. Where the dwelling is designed or adapted to suit the needs of a physically handicapped person and the exchange would result in it being occupied by someone else without those needs;
6. Where the dwelling is in a group of dwellings let to people with special needs near some special facility (for example an old people's club) and the exchange would result in the dwelling being occupied by someone without those needs.
